  6. BEFORE USING THE IBM ANTI-VIRUS PRODUCT (SCANNING PROGRAM) YOU SHOULD
  7. CAREFULLY READ THIS AGREEMENT.  YOU WILL INDICATE YOUR  ACCEPTANCE OF
  8. THIS AGREEMENT BY YOUR INITIAL USE OF THE SCANNING PROGRAM.  IF YOU DO
  9. NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU SHOULD  PROMPTLY RETURN
  10. THE UNUSED SCANNING PROGRAM AND ANY MONEY YOU HAVE PAID WILL BE REFUNDED.

  13. 1. INTRODUCTION    Some individuals and groups, regrettably, are introducing
  14. ---------------    "virus"  programs into computer systems in an attempt to
  15. damage the systems.  A number of firms in the computer industry are addressing
  16. this challenge. IBM has developed the Scanning Program for its own internal
  17. use to help detect the presence of some of these virus programs.  Since you
  18. may face some of the same problems, IBM  is  making  the  Scanning  Program
  19. available  to assist you in addressing this industry problem.
  20.  
  21. You should note that the problem is an evolving one.  As virus detection
  22. programs are developed and made available, new virus programs may emerge
  23. which seek to avoid detection.  Your continued attention to appropriate
  24. back-up procedures and physical security measures is essential.
  25.  
  26. Since the Scanning Program is itself a program, it is not immune to tampering.
  27. To help prevent tampering, you should exercise great caution in controlling
  28. the access, use and reproduction of the Scanning Program.
  29.  
  30. Because of the above considerations, IBM can only distribute the Scanning
  31. Program on an "AS IS" basis.  The terms of the "AS IS" license follow.

  34. 2. LICENSE    This is a license agreement and not an agreement for sale.
  35. ----------    You obtain no rights other than the license granted you by
  36. this Agreement.  Title to the Scanning Program, and any copy made from
  37. it, is retained by IBM.  IBM licenses your use of the Scanning Program
  38. in the United States and Puerto Rico.
  39.  
  40. You assume all responsibility for the selection of the Scanning Program
  41. to achieve your intended results, the installation of and use of the
  42. Scanning Program, and the taking of corrective action regarding computer
  43. programs in which suspected virus "infection" is detected.
  44.  
  45. You may:
  46. a) use a copy of the Scanning Program on one or more machines at a time;
  47. b) make additional license copies of the Scanning Program for distribution
  48.    and use within your enterprise.  YOU MAY NOT distribute copies of the
  49.    Scanning  Program  to any  third party  or over networks  by means of
  50.    electronic "bulletin boards";
  51. c) make copies of the Scanning Program for backup purposes only in support
  52.    of your use; and
  53.  
  54. You shall reproduce and include the copyright notices and any other legend
  55. on all such copies of the Scanning Program.
  56.  
  57. You may not:
  58. a) use, copy or distribute the Scanning Program except as provided in this
  59.    Agreement or as otherwise specified by IBM in writing;
  60. b) modify, merge or transfer copies of the Scanning Program;
  61. c) reverse assemble or reverse compile the Scanning Program; and/or
  62. d) sub-license, rent, lease, or assign the Scanning Program or any copy of it.

  65. 3. DISCLAIMER OF WARRANTY  IBM LICENSES THE SCANNING PROGRAM ON AN
  66. -------------------------  "AS IS" BASIS, EXCLUSIVE OF ANY WARRANTY,
  67. EXPRESS OR IMPLIED,  INCLUDING,  BUT  NOT  LIMITED TO, THE IMPLIED
  68. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

  70. Some states do not allow the exclusion of implied warranties, so the
  71. above exclusion may not apply to you.

  73. IBM does not warrant that the Scanning Program or its documentation is
  74. free from claims by a third party of  copyright,  patent or  trademark
  75. infringement or the like.

  78. 4. LIMITATION OF REMEDIES  IBM's entire liability and your exclusive
  79. -------------------------  remedy shall be as set forth in this Section.
  80.  
  81. For any claim related to the subject matter of this Agreement, IBM's
  82. liability for actual damages, regardless of the form of action, will
  83. be limited to the money you paid to IBM for the license for the copy
  84. of the Scanning Program that caused the damages or that is the subject
  85. matter of, or is directly related to, the cause of action.   This
  86. limitation will not apply to claims for bodily injury or damages to
  87. real or tangible personal property for which IBM is legally liable.
  88. In no event will IBM be liable for any lost profits, lost savings, or
  89. any incidental damages or other economic consequential damages, even
  90. if IBM, an IBM Authorized Dealer or an IBM approved supplier has been
  91. advised of the possibility of such damages, or for any damages claimed
  92. by you based on any third party claim.

  94. Some states do not allow the limitation or exclusion of incidental or
  95. consequential damages so the above limitation or exclusion may not apply
  96. to you.

  99. 5. GENERAL  You understand that the Scanning Program detects only a
  100. ----------  limited number of computer viruses.  The Scanning Program
  101. is itself subject to computer viruses and other forms of tampering.
  102.  
  103. IBM does not guarantee that the Scanning Program's operation will be
  104. uninterrupted or error free.  IBM does not provide service or defect
  105. correction for the Scanning Program.
  106.  
  107. If you have not already paid IBM for this product, you agree to send a
  108. check to IBM at the following address:

  113. If you have received this product on prepackaged media from IBM or
  114. an authorized IBM distribution agent, the amount owed is thirty-five
  115. dollars.
  116.  
  117. If you have received this product electronically from IBM or on media
  118. created for you by an IBM representative, the amount owed is as follows:
  119. a) If you have not already paid IBM for this product or the prior version
  120.    of this product (IBM  Virus  Scanning  Program), the amount owed is
  121.    thirty-five dollars for your original license.
  122. b) If you have already paid  IBM  for an original license, the amount owed
  123.    is ten dollars.  However, IBM waives charges for any additional license
  124.    copies made in accordance with the license provisions of Section 2.

  126. You may terminate your license at any time by destroying all your copies
  127. of the Scanning Program.
  128.  
  129. IBM may terminate your license if you fail to comply with the terms and
  130. conditions of this Agreement.  Upon such termination, you agree to destroy
  131. all your copies of the Scanning Program.
  132.  
  133. You agree that you are responsible for payment of any taxes resulting
  134. from this Agreement.

  136. Neither party may bring an action, regardless of form, arising out of
  137. this Agreement more than two years after the cause of action arose.

  139. This Agreement will be construed under the Uniform Commercial Code of
  140. the State of New York.
